You are responsible for all activity under your account
You must provide accurate account information

4. Acceptable Use

You must use the platform only for lawful, permission-based email communication.

You must:

Send emails only to recipients with valid consent or lawful basis
Include a clear unsubscribe mechanism where required
Honor unsubscribe and suppression requests
Comply with GDPR, CAN-SPAM, and other applicable laws

You must not:

Send spam or unlawful messages
Use purchased, scraped, or unauthorized lists
Send deceptive, fraudulent, or misleading content
Use the platform for phishing, malware, scams, or illegal activity
Attempt to bypass sending limits, throttling, or abuse controls

5. Deliverability and Performance

We do not guarantee email delivery rates, inbox placement, open rates, click rates, revenue, or campaign performance.

6. Data and Content Responsibility

You retain ownership of your data. You are responsible for the legality of your lists, the accuracy of your content, and your compliance with data protection and email laws.

7. Suspension and Termination

We may suspend, throttle, restrict, or terminate accounts if we detect:

Spam, abuse, or excessive complaints
Violation of these Terms
Risk to platform reputation or infrastructure
Illegal or harmful activity

Suspension may happen without prior notice where necessary to protect the platform or third parties.

8. Third-Party Services

The platform may rely on SMTP providers, hosting providers, analytics services, and other third-party infrastructure. We are not responsible for third-party failures.

9. Limitation of Liability

To the maximum extent permitted by law, Kokobar DOOEL is not liable for indirect damages, loss of revenue, loss of data, deliverability issues, blacklisting, account suspension, or third-party service failures.

10. Indemnification

You agree to indemnify and hold Kokobar DOOEL harmless from claims, damages, or liabilities arising from your use of the platform, your content, your recipient data, or your violation of applicable laws.

11. Changes

We may update these Terms. Continued use of the platform means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of North Macedonia.
